An Australian couple is suing their doctor and health care provider because they were not told that their baby was at high risk for Down syndrome.

Jean and Terrence McDonnell say they were shocked when their daughter Bethany was born with the chromosomal disorder and indicated they would have terminated the pregnancy if they had known about their daughter’s condition in advance.

In the lawsuit the couple allege that their doctor, Sachin Choudhary, should have advised them of a risk for Down syndrome after an ultrasound showed the level of fluid in the baby’s neck. They say the doctor’s actions left them “deprived of the opportunity to discontinue the pregnancy” and led them to “suffer psychological injury and economic loss,” reports The (Australia) Independent Weekly.
