NEWARK, N.J. — The family of a 7-year-old boy with autism who was allegedly beaten by a teacher’s aide in a Newark school has settled a federal lawsuit for $1.2 million.

The alleged attacks occurred at Quitman Street Community School and were partially captured on school surveillance video, according to police and the lawsuit filed in May 2022.

The aide, Corey D. Foushee, allegedly dragged the child in his chair, pushed him down a staircase, then pushed him to the floor with an open hand, according to the lawsuit.

“(The child) was covered with fresh bruises all over his body and face, and his tooth and mouth were bleeding as well,” states the suit filed in U.S. District Court in Newark.

The boy’s mother told police her child was harmed by the same aide in fall 2021, in an incident that was allegedly never investigated by school officials.

A grand jury indicted Foushee, 34, of Newark, earlier this year on two counts of aggravated assault and two counts of endangering the welfare of a child, according to court records.

A spokesman for the Essex County Prosecutor’s Office said Foushee is due in court for a disposition hearing on June 26. Attorney information for Foushee was not immediately available.

The settlement agreement calls for $750,000 to come from the Newark school board’s insurance carrier and an additional $225,000 will come from the board. Another payment of $225,000 will be paid out by the board in 2024, according to the agreement.

The family’s attorney, Patrick Toscano of Caldwell, said he could not comment on the case due to confidentiality provisions in the agreement.

“The matter has been amicably resolved,” Toscano said.

Nancy Deering, spokeswoman for Newark Public Schools, said the district had no comment on the case.
